Construction
Permits are required for all accessory structures over 120 square feet in area. All accessory structures over 120 square feet must be built to standards established in the MN State Building Code, and suitably anchored to the ground. Temporary structures such as carports are prohibited.
Setbacks
Accessory structures 120 square feet in area or less must be located at least 5 feet from any property line and may not be closer than 20 feet to a side lot line when adjacent to a public right of way. Accessory structures greater than 120 square feet in area must be located at least 10 feet from rear property lines. Please contact the City of Apple Valley Planning Department at (952) 953-2575 to discuss the placement of your accessory building.
Location in Easement Prohibited
Location in utility easements of record is prohibited without consent of the city and/or the public utility holding the easement.
Maintenance
All accessory structures must be adequately maintained so as not to be an eyesore or a public nuisance.
