Backyard pools are a great way to find relief from the summer heat, but they can also pose a safety hazard when access is not properly restricted. Perimeter barriers must be in place and maintained to restrict unintended access to the pool.
In-ground pools and pools less than 4 feet in height must be surrounded by an approved barrier such as a security fence, freestanding or building wall. The barrier must be a minimum of 4 feet in height above grade measured on the exterior facing side. Above ground pools greater than 4 feet in height do not require perimeter barriers as the wall of the pool itself fulfills the barrier requirement. When not in use or left un-attended, however, access to above ground pools (i.e. ladders or stairs) must be properly restricted by means of removing, locking, or securing such access points to prevent un-intended access.
Building permits are required for the installation of all permanent pools (not collapsible). Pool water should be adequately maintained (treated and filtered) and not allowed to stagnate. Pools may not be located in front or side yards and should not be located in any easements of record. Temporary pools must be taken down and properly stored away no later than November 1st.
If you have any questions regarding these or additional pool requirements, or to report a pool that does not meet the noted barrier requirements in your neighborhood, please contact Code Enforcement at 952.953.2570; or by email at codeenforce@ci.apple-valley.mn.us.
